TERMS AND CONDITIONS
We reserve the right to amend these terms and conditions at any time, and your use of the website or purchase of our classes, events, memberships or products following any amendments will represent your agreement to be bound by these terms and conditions as amended. To ensure you keep up to date we recommend you read through these terms and conditions on a regular basis.
Operational service
These terms apply any time you make a booking to attend one of our classes, purchase one of our passes, or purchase one of our memberships. If anything in this document differs from what you have been told by our People, this document will take precedence.
We reserve the right to add to, change or remove our operational procedures from time to time. These changes include but are not limited to changes to operating hours, opening days, closing for refurbishment or public holidays, and amending class types, styles, teachers and times All changes will appear on our website or in the studio.
We do not allow any personal items such as posters, crystals, phones, photographs, bags or any personal affects on any students Yoga Mat.
All items should be placed away, at the back of the studio, in the shelving area provided.
The studio is a neutral, Trauma informed space, and Teachers reserve the right to ask anyone who does not adhere to our health and safety conditions to leave the studio.
Animals are not permitted in the studio.
Cancellation and refunds
All classes/workshops/events and memberships are non transferable or refundable. Missed classes/workshops and events will not be refunded or credited.
The fee paid by me for participation in The Collaborative classes, workshops or events is non-refundable. The Collaborative in their sole discretion may grant refunds to me without prejudicing any of their rights.
The Collaborative reserves the right to cancel any students membership, pass, event, or retreat booking, without explanation. Refunds will be given at the studios discretion.
Membership terms
MEMBERSHIP TERMS
On signing our membership agreement your membership will continue on a fortnight-to fortnight basis until terminated. All terms and conditions agreed to in this membership will apply until your membership is terminated.
MEMBERSHIP INCLUSION
Your Collaborative membership allows you unlimited yoga classes plus 1 event per month held by The Collaborative Maroubra.
SUSPENSION OF MEMBERSHIP
You may elect to suspend your membership for a period of 7 days to 90 days up to 4 times a year. Suspension requests must be submitted by email to info@thecollaborativemaroubra.com 3 days ahead of your intended suspension period. Extensions to suspension periods will be reviewed on a case by case basis.
TERMINATION OF MEMBERSHIP
Your membership may be cancelled by giving 4 weeks notice. Cancellation notices should be submitted in writing and delivered by email to info@thecollaborativemaroubra.com
Fortnightly payments will continue to be deducted until the 4-weeks notice has expired and your termination date is effective.
TRANSACTION CHARGES
All payments will be deducted by direct debit from our payment provider Ezidebit. Failed payments will incur an administration fee of $10. Failed payment fees will be included in the next direct debit payment processed.
If your direct debit is declined The Collaborative will contact you by email to let you know. Your direct debit will be automatically reprocessed again 7 days later. If your direct debit fails on more than 2 occasions for the same payment we reserve the right to suspend your service until the payment is paid in full.
REFUNDS
No refunds either in full or in portion are available for any un-used sessions during a fortnightly payment cycle. Memberships are non transferable or shareable.
LATE CANCEL FEES
Late cancels / No shows.
All cancellations to classes will need to be made 1 hour prior to the class commencing. Any cancellations made within the hour before a class commences will incur a $15 fee. Anyone who doesn't cancel and doesn't show up to class will also receive this $15 fee. All charges will be made to the card on file.
Waitlist If you add yourself to a waitlist, treat it as if you are attending that class. If/once someone else cancels a booking you will automatically be bumped into the class and receive an email (to the same account your mind body is registered too) to let you know you have been added
Privacy policy
We are committed to safeguarding personal privacy. We recognise that individuals have a right to control how their personal information is collected and used. Providing personal information is an act of trust and it is taken seriously. We will not collect or monitor any personal information about an individual without their consent. The only personal information collected is what has been provided voluntarily. Personal information will be used for the following purposes:
To fulfill the obligations of your membership
To provide information about products, service and/or special offers
To obtain opinions or comments about products and/or services
To record statistical data for marketing analysis
We will endeavour to take all reasonable steps to keep secure any personal information recorded, and to keep this information accurate and up to date.
Liability disclaimer
By attending a class, workshop or event at The Collaborative, I hereby agree that the following terms and conditions have been read and understood by me.
I am participating voluntarily in classes, workshops or events offered by The Collaborative.
I have been examined by a licensed medical practitioner (“Practitioner”) within the past six months and have been found by such Practitioner to be able to perform all vigorous stretching and Yoga Exercises which I may undertake during my participation in the yoga class, workshop or event organized by The Collaborative.
I will faithfully follow all instructions given to me by The Collaborative and their associated teachers, as to when, where, and how to perform and not to perform the Yoga Exercises.
I agree and acknowledge that participation in any Yoga Exercises could constitute a risk of serious injury to myself, including permanent paralysis or death. I voluntarily and knowingly recognize, accept and assume this risk and warrant that I am physically fit and able to perform the Yoga Exercises without risking serious injury, including permanent paralysis or death. I acknowledge that neither The Collaborative, associated teachers, staff or employees shall be nor be deemed to be responsible or liable (whether in contract of in tort or under any statute whatsoever), for any injury, illness or other mishap I sustain arising from or out of, or in any way directly or indirectly connected with the Yoga Exercises.
I understand and acknowledge that I am to receive instruction in Yoga Exercises and theory only. The Collaborative, associated teachers, staff or employees of The Collaborative, are not liable for, nor are expected to provide any advice, training or medical assistance other than in the form of Yoga Exercises.
I indemnify and will at all times hereafter well and sufficiently indemnify and keep fully indemnified The Collaborative, associated teachers, staff or employees of The Collaborative from and against all actions, suits, causes of action, proceedings, claims, costs and expenses whatsoever which may be taken or made against The Collaborative, associated teachers, staff or employees of The Collaborative or incurred or become payable by The Collaborative, associated teachers, staff or employees of The Collaborative in connection with or arising out of any such injury, illness or mishap to me.
I indemnify The Collaborative, associated teachers, staff or employees of The Collaborative against any loss or damage of my personal belongings that may arise through my attending this event, class or workshop.
Online Yoga
Your access to and use of our online yoga service including purchase of the product is provided subject to the following terms and conditions. We reserve the right to amend this Notice at any time, and your use of the online yoga services on our website following any amendments will represent your agreement to be bound by these terms and conditions as amended.
To access the online yoga provided on this website, you must purchase our online yoga product.
On purchasing our online yoga product we will provide you with a password to access the online yoga services.
Your username and password are intended for personal use only, sharing of logins, or using the services in connection with any commercial purposes except as specifically approved by The Collaborative Maroubra is prohibited and may result in termination of services.
Except as permitted under the Copyright Act 1968 (Cth), you are not permitted to copy, reproduce, republish, distribute or display any of the information on this website without our prior written permission.
Access to our online yoga services will be provided for a minimum period of 1 year from the date if purchase. During this time we reserve the right to change the online classes offered.
Our services are provided to adults over the age of eighteen (18) years. By proceeding to purchase through our website, you acknowledge that you are over 18 years of age.
We reserve the right to terminate your registration to the online yoga services at any time if you breach these terms and conditions.
You agree that your use of the online yoga services shall be at your sole risk. The materials are provided “as is” and without warranties of any kind, either express or implied. To the fullest extent permitted by law, The Collaborative Maroubra, its officers, directors, employees and agents disclaim all warranties, express or implied, in connection with the online yoga services and your use thereof.
The Collaborative Maroubra assumes no liability or responsibility for any interruption or cessation of transmission to or from the Website, or any bugs, viruses, trojan horses or the like which may be transmitted to or through the website by any third party.
These terms and conditions are to be governed by the laws of NSW and any action related to these terms and conditions shall be venued solely in New South Wales.
We have not waived our rights if we do not enforce any right contained in these terms and conditions during a particular timeframe. The most up to date version of these terms will always apply.
